ADVISEMENTS OF RIGHTS (INFRACTION)

DEFENDANT’S NAME: Case No:

You have the following legal rights:

1.     You have the right to have your citation read in open court.

2.     You have a right to an attorney at all stages of the proceedings.

3.     You have a right to a continuance to obtain an attorney if you want one.

4.     You have a right to call your own witnesses and if necessary to use power of the Court to subpoena witnesses to present evidence on your behalf.

5.     You have a right to confront and cross-examine the witnesses against you.

6.     You have a right against self-incrimination, which means you cannot be required to testify. You may waive this right and testify on your behalf if you wish, but by doing so you will be giving up your right against self- incrimination, you could be questioned about anything you say, and anything you say can be used against you.

7.     You may plead guilty or nolo contendre (no contest). Nolo contendre has the same legal effect as a plea of guilty but cannot be used against you as an admission in any civil suit.

8.     You have the right to a court trial

9.     You have the right to a speedy trial within 45 days of your entry of a not guilty plea. You may waive this right if you need more time.

10.   You have a right to wait at least six hours before sentence is imposed after a conviction; sentence must be imposed within five days. You may waive these rights.

11.   You have the right to appeal a conviction.

12. The maximum sentence on most infractions is a fine and assessment of $340.00 though some may go as high as $880.00 or higher. If you are on probation or parole, that could be revoked even without a conviction on this new case.

I have read the above “Advisement of Rights” and fully understand these rights. I enter a not guilty plea and request this matter be set for court trial. I further waive time for court trial so the trial may be set after 45 days.
